Successive Litigation Deemed Abuse of Process; Appeals Dismissed with Costs
In a significant judgment, the Andhra Pradesh High Court has dismissed the appeals filed by M/s. McDowell and Co. Ltd., challenging the withdrawal of land exemption granted under the Urban Land Ceiling and Regulation Act, 1976. The court, comprising Chief Justice Lisa Gill and Justice R. Raghunandan Rao, found that the successive writ petitions and appeals filed by the petitioner amounted to an abuse of the legal process.
The case revolved around a land exemption granted to M/s. Hindustan Polymers Limited, which later amalgamated with M/s. McDowell and Co. Ltd. The exemption was originally granted for constructing residential accommodations for company officers but was withdrawn after the conditions were not met. Despite the company's appeals and petitions, the High Court ruled that the withdrawal of the exemption was valid, especially given the failure to fulfill the stipulated conditions.
The court noted that the petitioner had engaged in prolonged litigation, despite earlier judgments, including a Supreme Court dismissal of the Special Leave Petition, which had attained finality. The court emphasized that the petitioner's actions were a clear attempt to prolong litigation unnecessarily, thus constituting an abuse of the process of law.
In its ruling, the court highlighted that the exemption was withdrawn after due process, and possession of the surplus land was taken by the state. Consequently, the petitioner could not benefit from the Urban Land Ceiling and Regulation Repeal Act, 1999, as the land was already vested with the state before the Act's repeal.
Furthermore, the court imposed a cost of Rs. 50,000 on each of the five writ appeals, directing the amount to be deposited in the account of the Andhra Pradesh State Legal Services Authority.
The judgment sends a strong message against the misuse of the judicial process through successive and frivolous litigation.
