Bhopal, Jul 20 A court in Bhopal has acquitted a man in a cheque bounce case, setting aside a trial court order sentencing him to two years' imprisonment and directing him to pay Rs 38.5 lakh as compensation.
Additional Sessions Judge Vidhan Maheshwari allowed the appeal filed by Dhanesh Chaturvedi against the Judicial Magistrate First Class (JMFC) court's judgment dated of June 9 last year.
The JMFC court had convicted Chaturvedi and sentenced him to two years in jail besides directing him to pay Rs 38.5 lakh as compensation and Rs 75,000 towards litigation expenses.
The complaint, filed by KGN Colonisers Private Limited director Syed Azam Ali, alleged Chaturvedi had issued 13 cheques worth Rs 18.45 lakh for transactions relating to plots in Imperial City residential project.
Appearing for Chaturvedi, advocate Rajesh Nema argued the complainant had failed to establish the appellant's legal liability arising out of the disputed cheques.
Allowing the appeal, the sessions court last week held that the complainant had failed to prove that the cheques in question had been issued towards discharge of any legally enforceable debt or other liability.
Holding that the legal liability of the appellant had not been established, the court acquitted Chaturvedi.
