Bombay High Court Grants Interim Relief to Packshot India in Arbitration Dispute with Trent Limited

Court Orders Preservation of Key Documents and Records for Effective Arbitration Proceedings

In a significant ruling, the Bombay High Court has granted interim relief to Packshot (India) Private Limited in its arbitration dispute with Trent Limited. The judgment, delivered by Justice Amit Borkar, addresses the need for preserving crucial documents and records, ensuring that the arbitration process remains effective and fair.

The dispute arises from a service agreement between Packshot and Trent, under which Packshot provided specialized photography and e-commerce solutions to Trent's retail business. Allegations of breach of confidentiality and non-solicitation clauses by Trent led Packshot to seek interim measures under Section 9 of the Arbitration and Conciliation Act, 1996.

The court was approached by Packshot to preserve records, including emails and vendor-related documents, asserting the need for these documents in the upcoming arbitration proceedings. Packshot claimed that the engagement of Yoshi Agency Private Limited by Trent was in violation of the contractual terms and resulted in the misuse of confidential information and solicitation of Packshot's employees.

Justice Borkar, while acknowledging the delay in filing the petition, emphasized that preservation of evidence is crucial, especially when the subject matter is still available and necessary for arbitration. The court ordered Trent to preserve all relevant documents, records, and electronic data pertaining to its engagement with Yoshi Agency. However, it denied Packshot's request for a blanket injunction against Trent's business activities, allowing Trent to continue its operations.

The judgment highlights the importance of interim measures in arbitration to safeguard the interests of the parties involved without prejudging the merits of the case. The court's decision ensures that the arbitral tribunal will have access to all necessary evidence, facilitating a fair resolution of the dispute.

The case underlines the complex nature of arbitration disputes involving confidentiality and non-solicitation clauses, and the role of courts in granting interim relief to maintain the integrity of the arbitration process.

Bottom line:-

Arbitration and Conciliation Act, 1996 - Section 9 - Interim relief for preservation of records and controlled disclosure of documents to ensure effective arbitration proceedings - Preservation of evidence does not decide liability but ensures availability of relevant evidence for Arbitral Tribunal.

Statutory provision(s): Arbitration and Conciliation Act, 1996 - Section 9
