Mumbai, Sep 2 Police on Wednesday opposed the bail application of a 48-year-old woman arrested for allegedly running over and killing an eight-year-old boy in Bandra.
The bail application filed by accused Medha Rawal will be heard on Thursday.
She denied that she was using a mobile phone while driving her car at high speed. She only used the phone after the "unfortunate incident" to inform her husband, Rawal said.
The fact could be verified from her call data record, the bail plea said, while describing the accident as "unfortunate and unintentional".
The boy suddenly came in front of the car while crossing the road, giving Rawal no reasonable opportunity to apply the brakes, the bail plea further said, denying that she was driving in a rash and negligent manner.
The police, in their reply, stated that the offence was of a serious nature and investigation was underway.
"Witnesses reported that the accused was driving at high speed while talking on her mobile phone. The child sustained severe injuries after being hit and run over," the police response stated, seeking that bail be refused.
The incident occurred around 2:15 PM on Sunday opposite Jijamata Garden in Bandra.
Ansh Gupta, a Class 3 student at Carmel School and the only son of a street vendor, was crossing the road when an Innova driven by the accused struck him.
Rawal was booked under BNS Sections 105 (culpable homicide not amounting to murder), 281 (rash driving), 125 (act endangering life or personal safety), and Section 184 of the Motor Vehicles Act.
