Court dismisses plea for transitional relaxation in eligibility criteria for Teacher (Agriculture) posts


In a significant ruling, the Chhattisgarh High Court has dismissed a writ petition seeking a one-time transitional relaxation in the eligibility criteria for the recruitment of Teacher (Agriculture) positions. The petitioners, led by Vishnu Ditya Raj, had sought the court's intervention to allow participation in the recruitment process without possessing the mandatory Bachelor of Education (B.Ed.) qualification, arguing for a grace period to meet the new requirement.


The court, presided over by Justice Bibhu Datta Guru, emphasized that the earlier exemption from the B.Ed. qualification, declared unconstitutional by a Division Bench, could not be bypassed through judicial intervention. The petitioners contended that the new qualification requirement was introduced without sufficient transitional time for candidates previously eligible under earlier rules. However, the court noted that the authority to set eligibility criteria lies with the state government and that judicial orders cannot override mandatory qualifications prescribed by law.


The recruitment process had been altered following a Division Bench decision in the case of Ashokanand Patel v. State of Chhattisgarh, where the exemption from the B.Ed. qualification for Teacher (Agriculture) posts was deemed unconstitutional. The state's decision to mandate the B.Ed. qualification aligns with the National Council for Teacher Education (NCTE) Regulations, 2014, ensuring that the educational standards for teaching positions are upheld.


Despite the petitioners' plea for a transitional allowance, the court maintained that adhering to prescribed qualifications is essential for maintaining the integrity of the recruitment process. Justice Guru emphasized that eligibility criteria and qualification requirements are the prerogative of the rule-making authority, and courts cannot alter these standards to accommodate individual candidates.


The petitioners' request to quash the advertisement for the Teacher (Agriculture) positions was also denied, reinforcing the importance of compliance with established educational requirements. The court's decision reiterates the judiciary's role in upholding constitutional mandates rather than creating exceptions to established rules.


This judgment underscores the legal principle that while courts can review the fairness of administrative decisions, they cannot substitute their views for those of the competent authorities regarding eligibility criteria and qualifications.
