Frequent Transfers Do Not Constitute Arbitrary Actions Without Exceptional Circumstances, Rules Court
In a recent decision by the Chhattisgarh High Court, presided over by Mr. Justice Bibhu Datta Guru, the court dismissed a writ petition challenging the transfer order of an employee, Ankit Yadu, from the Municipal Corporation Bhilai Charoda to Municipal Corporation Rajnandgaon. The petitioner, who had been transferred multiple times, sought a posting at his initial workplace, Municipal Corporation Raipur, citing frequent relocations and surplus status at previous postings.
The petitioner, Ankit Yadu, initially appointed at Municipal Corporation Raipur, was transferred first to Municipal Corporation Risali and then to Bhilai Charoda due to surplus staff conditions. Despite his requests for repatriation to Raipur being repeatedly denied, he approached the court, arguing that the transfers were arbitrary and lacked consideration of his representation for deputation or repatriation.
The court, upon reviewing the facts, noted that the petitioner had been found surplus at each transferred location. It emphasized that the decision on where to post a surplus employee is an administrative matter, and courts generally do not interfere with such decisions unless exceptional circumstances are demonstrated. The court highlighted that the petitioner’s preference for a particular posting location does not bind the authorities, reiterating the employer's discretion in transfer matters.
Justice Bibhu Datta Guru cited the precedent set in the case of Namrata Verma v. State of Uttar Pradesh, reinforcing that employee transfer decisions lie with the employer, based on administrative needs, and not on the employee’s preference.
In conclusion, the court found no merit in the petitioner’s arguments, noting that frequent transfers alone do not invalidate a transfer order. The writ petition was thus dismissed, affirming the transfer to Municipal Corporation Rajnandgaon as a legitimate administrative decision.
Bottom Line :
Frequent transfers and requests for posting at preferred locations cannot render transfer orders arbitrary unless exceptional circumstances are demonstrated.
