Claims of Anti-Competitive Practices Across Multiple Sectors Deemed Unsubstantiated

In a significant decision, the Competition Commission of India (CCI) has dismissed allegations of anti-competitive practices against Reliance Jio Infocom Limited and numerous other companies across various sectors. The case, filed by Mr. Goutam Mohanta, alleged contraventions of Sections 3 and 4 of the Competition Act, 2002, which pertain to anti-competitive agreements and abuse of dominant position, respectively.


The allegations spanned sectors including logistics, telecommunications, Government-e-Marketplace (GeM) procurement, and several other areas, asserting coordinated conduct such as price alignment, route allocation, and exclusionary practices. However, the CCI found the claims to be lacking in prima facie evidence necessary to proceed with an investigation.


The Commission, chaired by Ravneet Kaur, with members Sweta Kakkad and Deepak Anurag, observed that the Information filed did not provide sufficient material, documentary evidence, or specific allegations against the identified Opposite Parties (OPs). The CCI emphasized that mere similar pricing or market characteristics cannot automatically imply collusion or anti-competitive conduct without substantial evidence.


In particular, the claims of price alignment among logistics operators and bid-rigging in GeM procurement were dismissed due to the absence of comparative data and supporting evidence. Similarly, concerns regarding similar tariff structures in the telecom sector were found to be based on publicly available data without any indication of coordinated actions among the OPs.


The CCI concluded that the jurisdiction of the Commission cannot be invoked based on speculative assertions without foundational facts indicating a prima facie contravention. Consequently, the case was closed under Section 26(2) of the Competition Act, 2002, which allows for dismissal in the absence of sufficient evidence.


This decision underscores the necessity for concrete evidence when alleging anti-competitive practices, highlighting the CCI's commitment to ensuring fair competition without engaging in unwarranted investigations.
