New Delhi, Aug 1 A Delhi court has expressed disappointment over the conduct of the Narcotics Control Bureau (NCB) in contesting bail applications after its officials failed to specify evidence linking an accused to a case.
Hearing the bail plea of the accused, Special Judge Jitendra Pratap Singh directed the NCB zonal director to furnish an explanation on the agency's insufficient response in countering the plea.
In the order dated July 30, the court said that neither the original investigating officer nor the case handling officer had been able to specify the material that directly connects the applicant or accused to the alleged offence.
“With great reluctance, this court is expressing its disappointment as to the conduct of the affairs of the agency in contesting the bail applications.
“On account of heavy pendency of the matters before the court, generally a notice of about 45 days on bail applications is issued, and on several such occasions, the court has to adjourn the hearing for want of requisite assistance from the prosecution.
“In such circumstances, it is directed that the copy of this order be placed before the zonal director, NCB, asking him to furnish an explanation in light of the reply to the instant bail application,” Singh said.
He directed the NCB director to state whether the reply filed in the matter is sufficient for recording the agency's opposition to the present bail application.
