Full Bench Decision Emphasizes Strict Adherence to Approval Timelines Under Delhi School Education Act
In a landmark judgment, the Delhi High Court has clarified the legal position regarding the suspension of employees in recognized private schools under the Delhi School Education Act, 1973. The Full Bench, comprising Justices C. Hari Shankar, Om Prakash Shukla, and Renu Bhatnagar, has pronounced that if a suspension order is not approved by the Director of Education within 15 days, it automatically lapses and cannot be revived by any subsequent approval.
The case, Hema Bajaj v. Rao Mehar Chand Saraswati Vidya Mandir School, arose from a conflict in judicial interpretations by previous Division Benches on the consequence of delayed approvals. The court has now unequivocally stated that any suspension order passed without prior approval must receive the Director's consent within the stipulated timeframe; otherwise, it ceases to exist.
The court’s decision drew from a comprehensive analysis of Section 8(4) of the Delhi School Education Act, emphasizing the necessity of strict compliance with procedural timelines to ensure fairness and accountability in employment actions. This decision aligns with the Supreme Court's precedent in Mrs. Y. Theclamma v. UOI, reinforcing that the lapse of a suspension order cannot be overturned by delayed administrative approvals.
The judgment underscores the importance of procedural diligence by school managements and the Director of Education, safeguarding employee rights against arbitrary suspension practices. The court also highlighted the potential for judicial review if the Director’s decisions are perceived as arbitrary or delayed, providing a legal recourse for managing committees facing administrative hurdles.
This clarification aims to maintain the balance between the authority of school managements and the rights of employees, ensuring decisions are made transparently and within the legal framework.
Bottom line:-
Delhi School Education Act, 1973 - If no approval is received to the order of suspension within 15 days, the suspension automatically comes to an end. Any subsequent approval by the Director of Education will not revive the suspension.
