Delhi High Court Directs Inclusion of Kashish Malik for Asian Games 2026 Despite Category Merger

Court affirms eligibility of bronze medalist Kashish Malik for Asian Games after weight category merger, overturning Ministry's decision.


In a significant ruling, the Delhi High Court has ordered the inclusion of Taekwondo athlete Kashish Malik in the Indian contingent for the upcoming Asian Games 2026, to be held in Aichi-Nagoya, Japan. The judgment came in response to a writ petition filed by Malik, who was declared ineligible by the Ministry of Youth Affairs and Sports due to the merging of weight categories.


Kashish Malik, who secured a bronze medal in the -53 kg category at the Asian Taekwondo Championships 2026 in Ulaanbaatar, Mongolia, was initially denied a slot in the Asian Games after the -53 kg and -57 kg categories were merged into a single -57 kg category. The Ministry's decision was based on the absence of the -53 kg category in the Asian Games and the interpretation that Malik's achievement in the now-defunct category did not qualify her for the merged category.


However, the Delhi High Court, presided by Justice Dr. Swarana Kanta Sharma, disagreed with this assessment. The court emphasized that the merger of weight categories should not disqualify an athlete who has already proven their mettle by winning a medal in a recognized qualifying event. The court further noted that Malik's performance at the Asian Taekwondo Championships met the eligibility criteria set forth by the Ministry's own circular dated September 24, 2025, which allows for an athlete to be nominated if they secured a sixth or better finish in the Senior Asian Championships within the last 12 months.


The court criticized the Ministry's interpretation as erroneous and self-defeating, stating that it would lead to an unreasonable situation where athletes are penalized for not competing in both categories, something that is not permissible under the rules. Justice Sharma directed the competent authority to immediately consider and forward Malik's name for the Asian Games, highlighting that no other Indian athlete had won a medal in the merged categories at the qualifying event.


The ruling has been welcomed by sports advocates and athletes alike as a reinforcement of fair play and recognition of athletic achievements, irrespective of administrative changes in competition structures.
