Court Quashes University's Interpretation of Recruitment Rules, Orders Fresh Examination under Revised Regulations
In a significant ruling, the Delhi High Court has directed the Indira Gandhi Delhi Technical University for Women to convene a Departmental Promotion Committee (DPC) to consider eligible candidates for promotion to the post of Assistant Registrar. This decision comes after the court quashed the university's communications denying Mrs. Manpreet Kaur, a Private Secretary, the opportunity for promotion under the recruitment rules of 2017.
Justice Sanjeev Narula, presiding over the case, highlighted that the university's interpretation of the 1:3 ratio between Private Secretaries and Section Officers was fundamentally flawed. The court emphasized that such ratios should not be applied arithmetically but through a running roster of vacancies. This method ensures equitable opportunities for promotions, rather than fractional allotments that could invalidate the promotional avenue for certain feeder cadres.
The judgment further clarified that the absence of a transitional provision in the revised 2021 Recruitment Rules does not entitle incumbents of the feeder cadre to retrospective benefits. Justice Narula underscored that promotions must be governed by the rules in effect at the time of consideration, not by those in force at the time of fulfilling eligibility criteria, aligning with the Supreme Court's precedent in the Raj Kumar case.
The court ordered the university to conduct a DPC, considering all eligible candidates under the 2021 rules, and to conclude the proceedings within eight weeks. However, any promotions granted will be effective from the date of the promotion order, with no retrospective benefits. The court's decision aims to rectify the university's oversight in implementing the prescribed recruitment rules, ensuring fairness and adherence to statutory quotas.
Bottom line:-
Recruitment Rules - Ratio of 1:3 between Private Secretaries and Section Officers - Promotion quotas should be operated through a running roster applied to successive vacancies, not by fractional allotments.
Statutory provision(s):
- Recruitment Rules (2017 and 2021)
- Supreme Court Rulings (Raj Kumar case)
- Departmental Promotion Committee (DPC) Guidelines
