Goodai Global Inc. Secures Legal Relief Against Trademark Infringement and Passing Off by Defendants
In a significant legal development, the Delhi High Court has granted an ad-interim injunction in favor of Goodai Global Inc., a plaintiff in a case concerning trademark infringement and passing off. The case, titled Goodai Global Inc. v. Shahnawaz Siddiqui and Ors., was heard by Justice Anup Jairam Bhambhani, who delivered the order on July 2, 2026.
Goodai Global Inc., represented by advocates Mr. C.D. Mulherkar and Ms. Chetanya Madan, sought legal relief against the defendants for allegedly infringing its registered trademark and trade-dress. The plaintiff argued that the defendants, including Shahnawaz Siddiqui and other associated entities, were using a deceptively similar mark to the plaintiff's "Beauty of Joseon" brand. This action, according to the plaintiff, constituted trademark infringement and passing off, harming the plaintiff's brand reputation and market presence.
The Delhi High Court found a prima facie case in favor of Goodai Global Inc., observing the striking similarity in the trade mark and trade-dress between the plaintiff's and the defendants' products. The court noted that despite the defendants' trademark having been previously struck off the Register of Trade Marks, they continued to use the infringing mark. Consequently, the court issued an ad-interim injunction restraining the defendants from manufacturing, selling, or advertising products using the plaintiff's trademark.
Moreover, the court directed defendant No.4, identified as Amazon Seller Services Private Limited, to de-list the infringing products from its platform. The court also permitted the plaintiff to communicate additional URLs requiring removal to ensure compliance with the order.
The injunction will remain in place pending the hearing and disposal of the application. The court's decision highlights the judiciary's commitment to protecting intellectual property rights and preventing unfair competition in the marketplace.
