FDC Limited secures injunction to protect its iconic ELECTRAL trade dress from misleading imitations by Wellford Pharmaceuticals.
In a significant ruling, the Delhi High Court, presided over by Justice Jyoti Singh, has issued an ex parte ad interim injunction in favor of FDC Limited, a leading pharmaceutical company, against Wellford Pharmaceutical Private Limited. The court found that Wellford Pharmaceuticals had infringed upon FDC Limited’s trademark and trade dress for its well-known product, ELECTRAL, by using deceptively similar packaging for their product, ELECTROFORD ADVANCED.
FDC Limited, the plaintiff, is renowned for its ELECTRAL brand, which has a significant market share in the Oral Rehydration Salts (ORS) sector in India. The company argued that Wellford Pharmaceuticals had adopted a trade dress that closely mimicked the distinctive green-and-white packaging of ELECTRAL, thereby misleading consumers and causing potential harm to FDC’s brand reputation and goodwill.
The court recognized the plaintiff’s registered trademark rights and acknowledged the unique status of the ELECTRAL packaging as a source identifier, protected under the Copyright Act, 1957. The court observed that the defendants’ use of a similar trade dress could cause consumer confusion, especially since both products are sold as over-the-counter items to a common consumer base.
In granting the injunction, the court highlighted the balance of convenience favoring the plaintiff, noting the potential irreparable harm to FDC Limited if the defendants were allowed to continue using the impugned packaging. The order restrains Wellford Pharmaceuticals from manufacturing, marketing, or selling products with packaging that is deceptively similar to that of ELECTRAL until further notice.
