The Delhi High Court, presided over by Justice Jyoti Singh, has granted an interim injunction in favor of Landmark Crafts Limited, preventing Shree Mange Ram and Sons from using a deceptively similar trademark for selling goods. This decision is part of the ongoing trademark infringement and passing off case where Landmark Crafts Limited, a renowned manufacturer of fasteners and screws, contends that the defendant's mark closely resembles its registered trademark 'HP', potentially confusing consumers and infringing on its trademark rights.


The judgment, delivered on July 6, 2026, emphasizes the exclusive rights of Landmark Crafts Limited over its 'HP' trademark, which has been in use since 1995 and has garnered significant goodwill and reputation. The plaintiff argued that the defendant's use of a similar mark, particularly with the letters 'ISI' placed vertically preceding 'HP', could mislead consumers into believing that the defendant's products are associated with or endorsed by Landmark Crafts Limited.


Justice Singh acknowledged the prima facie case established by Landmark Crafts Limited, highlighting the likelihood of consumer confusion and the potential for irreparable harm to the plaintiff's reputation and goodwill. The court has restrained the defendant from using the impugned mark and marketing or selling goods under it until the next hearing scheduled for November 4, 2026.


The plaintiff, represented by senior advocate Mr. J. Sai Deepak and his team, demonstrated the substantial investment made in building the 'HP' brand, including advertising, promotions, and engaging cricketer Ishant Sharma as a brand ambassador to reinforce its market presence. Landmark Crafts Limited has also shown adherence to quality standards, having been registered with the Bureau of Indian Standards and receiving favorable ratings from independent agencies.


The case underscores the critical importance of trademark protection and the legal recourse available to companies to safeguard their intellectual property rights. The interim injunction serves as a significant step in preserving the integrity of Landmark Crafts Limited's trademark and preventing potential market confusion.
