Court Directs National Medical Commission to Reassess Eligibility Criteria for Advanced Medical Courses


In a significant ruling, the Delhi High Court has directed the National Medical Commission (NMC) to reconsider its eligibility criteria for super specialty medical courses, mandating the inclusion of MD (Geriatric Medicine) as a qualifying degree. The judgment, delivered by Justice Jasmeet Singh, addresses the exclusion of MD (Geriatric Medicine) holders from applying for Doctorate of Medicine (DM) super specialty courses via the National Eligibility Cum Entrance Test-Super Specialty (NEET-SS) and Institute of National Importance - Super Specialty (INI-SS) examinations.


The case was brought forward by Dr. Kartik Mittal and other petitioners, who argued that the exclusion of MD (Geriatric Medicine) as a feeder qualification for DM courses was unjustified. They highlighted the oversight in the eligibility criteria that adversely affected their professional opportunities to specialize further in medicine.


The petitioners, represented by advocates Ms. Mudita Sharda and Ms. Gayatri Nandwani, pointed to the lack of substantial grounds for the exclusion of their qualification. The NMC had justified the exclusion citing insufficient physical infrastructure and a shortage of teaching staff and clinical material specific to Geriatric Medicine. However, the court found these reasons inadequate, emphasizing that the inadequacy in resources should prompt authorities to enhance the infrastructure rather than restrict educational and career advancement for qualified doctors.


Justice Singh underscored the importance of Geriatric Medicine, especially given the growing elderly population requiring specialized care. He stated that denying MD (Geriatric Medicine) holders the opportunity to pursue DM super specialty courses undermines their professional growth and the healthcare sector's capacity to cater to aging patients.


The court's directive compels the NMC to re-evaluate and include MD (Geriatric Medicine) as an eligible qualification for DM specializations without delay. This judgment is expected to have a significant impact on the medical education landscape, encouraging a more inclusive approach to super specialty qualifications.


The ruling also highlights the need for authorities to take proactive measures in expanding the number of seats and resources for Geriatric Medicine to meet the healthcare needs of the elderly population.
