Court Decrees Settlement Affirming Plaintiff's Exclusive Rights Over Trademark and Copyright


In a significant resolution of an intellectual property dispute, the Delhi High Court, presided over by Justice Anup Jairam Bhambhani, decreed the settlement of a long-standing trademark and copyright conflict between M/s K.W. Enterprises and M/s Karam Industrial Works. The judgment, delivered on July 2, 2026, closed the case CS (COMM) 1035 of 2016, affirming the plaintiff's exclusive rights over the contested intellectual properties.


The suit was originally filed by M/s K.W. Enterprises, the plaintiff, asserting sole ownership of the trademark "K.W." used for goods in class 12, against the defendant, M/s Karam Industrial Works. The conflict involved allegations of trademark and copyright infringements, with the plaintiff seeking legal redress to protect its intellectual property rights.


In the settlement, both parties mutually agreed on several key terms. The defendants acknowledged the plaintiff as the sole and exclusive owner of the trademark "K.W." and admitted to the validity of the plaintiff’s trademark registration under No. 566546 in class 12. Furthermore, the defendants undertook not to challenge or file objections against the plaintiff's trademark and copyright registrations. They also agreed to relinquish any deceptively similar trademarks and to support the cancellation of their own copyright registration A-52993/1995.


The court, after reviewing the terms of the settlement, found no impediments and decreed the suit in accordance with the agreed terms. The judgment also directed the court registry to draw up a decree sheet and append the settlement terms. All pending applications related to the case were disposed of as per the settlement.


This resolution underscores the importance of amicable settlements in intellectual property disputes, providing a framework for parties to resolve conflicts without prolonged litigation. The settlement not only affirms the plaintiff's rights but also ensures that the defendants comply with the agreed terms, preventing future disputes over similar issues.
