Court Acknowledges Homemaker's Contribution, Elevates Compensation from Rs. 2.06 Lakh to Rs. 9.51 Lakh
In a notable judgment, the Delhi High Court has substantially increased the compensation awarded to Uma Rani, a homemaker who sustained severe injuries in a motor accident. The court acknowledged the significant but often overlooked contribution of homemakers to the household economy, enhancing her compensation from the initial award of Rs. 2,06,860 to Rs. 9,51,396.
The accident, which occurred on October 2, 2012, resulted in Uma Rani suffering a 63% permanent disability due to a below-knee amputation. The Motor Accident Claims Tribunal (MACT) had originally awarded a sum based on the minimum wages of an unskilled worker, granting only a month's loss of income. However, the Delhi High Court recognized the homemaker's role and potential notional income, setting it at Rs. 10,000 per month, aligning with principles laid out in Supreme Court judgments.
Justice Anish Dayal presided over the case, emphasizing the need to recognize homemakers' contributions towards social equality. The court highlighted how homemakers manage a multitude of tasks that add significant value to the household and economy. Reflecting on Supreme Court precedents, the judge underlined the necessity of considering homemakers' efforts in economic terms, which traditionally go unrecognized.
The court also revised the compensation for non-pecuniary losses, increasing the amounts for pain and suffering and mental shock to Rs. 2,00,000 each, reflecting the profound impact of the injuries on Uma Rani's life. The enhanced compensation will be disbursed partly as a lump sum and partly through fixed deposit receipts to ensure financial security for the claimant.
