Delhi High Court Upholds Compensation for Husband in Wife's Fatal Accident Case

Court Recognizes Both Pecuniary and Non-Pecuniary Contributions of Deceased Earning Wife


In a significant ruling, the Delhi High Court upheld the Motor Accident Claims Tribunal's award of compensation to Vinay Jain, whose wife, Nidhi Jain, was killed in a road accident. The court dismissed the appeal by Oriental Insurance Co Ltd, which challenged the compensation on the grounds that Vinay, an earning member, was not financially dependent on his deceased wife. The court recognized that the concept of dependency extends beyond financial dependency to include non-pecuniary contributions, such as household management and gratuitous services.


The accident occurred in January 2022 when Nidhi Jain and her family were involved in a collision with a truck on National Highway-58. The tribunal had awarded Vinay Jain a compensation of approximately Rs. 57.54 lakh, considering Nidhi's income, future prospects, and her contributions to family expenses. The insurance company contended that the husband, being an earning member, should not receive compensation under the "loss of dependency" category. However, the court emphasized that dependency also encompasses the loss of gratuitous services and contributions to the household corpus.


Justice Anish Dayal, presiding over the case, noted that modern societal structures necessitate the acknowledgment of contributions made by both spouses, whether financial or otherwise. The court followed principles laid down in landmark cases like Pranay Sethi and Sarla Verma, maintaining that compensation calculations must adapt to evolving societal realities and reject patriarchal biases.


The judgment also highlighted the importance of recognizing the invaluable contributions of homemakers, drawing on national and international jurisprudence to bolster its stance. The court's decision is a step towards ensuring equitable compensation in motor accident claims, irrespective of traditional gender roles.
