Court Confirms 5% Annual Increase in Maintenance for Inflation and Cost of Living Adjustments
In a significant ruling, the Delhi High Court upheld a Family Court's decision mandating a husband to pay maintenance to his estranged wife and minor child, including an annual 5% increment to account for inflation and increased living costs. The judgment, delivered by Justice Madhu Jain, reinforced the lower court's assessment of the husband's financial capacity and dismissed his contention of earning only Rs. 11,000 per month despite holding a degree in Hospitality Management from Edinburgh Napier University, Scotland.
The case involved petitioner Rahul Gaurav Nagar, who challenged the Family Court's order directing him to pay ?15,000 per month to his wife, Neeta @ Savita, and ?10,000 per month to their minor child, along with a 5% yearly increase in the maintenance amount. The petitioner argued the court overestimated his financial capacity and improperly ordered automatic annual enhancements without assessing his future income.
The High Court, however, found the Family Court's order well-founded, noting that the evidence provided by the wife about her financial dependence and the child's educational expenses remained largely unchallenged. The court observed that the husband's claim of minimal income was unconvincing, considering his educational qualifications and lifestyle during the marriage.
In its judgment, the court emphasized that maintenance under Section 125 of the Criminal Procedure Code is intended to ensure the wife and child live with dignity, reflecting the lifestyle they enjoyed during the marriage. The court ruled that the 5% annual increment is a reasonable measure to counteract inflation and maintain the real value of the maintenance.
The court also reiterated the limited scope of revisional jurisdiction, highlighting that interference is only justified in cases of clear illegality or material irregularity. Finding none in this case, the High Court dismissed the revision petition, affirming the Family Court's original order.
Bottom line:-
Maintenance for wife and minor child - Annual enhancement of maintenance amount permissible under Section 125 Cr.P.C. - Court considers financial status, evidence, and inflation while granting maintenance and annual increment.
Statutory provision(s): Section 125, Section 397, Section 401 of the Criminal Procedure Code, 1973
