Court Quashes Directorate of Education's Order to Withhold Recruitment Process at St. Anthony's Boys Secondary School


In a significant ruling, the Delhi High Court has reinforced the autonomy of minority educational institutions in recruiting their teaching and non-teaching staff. The court quashed the Directorate of Education's (DoE) order directing St. Anthony's Boys Secondary School, a Christian minority institution, to halt its recruitment process. The judgment underscores that minority institutions have the right to appoint their staff without prior approval from the DoE, as long as the candidates meet the prescribed qualifications and experience.


The case revolved around the DoE's directive for the school to withhold its recruitment process based on a memorandum, citing the pending legal challenge against a related judgment. However, the court found that the school had followed due process in line with the Delhi School Education Act and Rules, 1973, and previous court orders, thereby dismissing the DoE's objections.


Justice Jasmeet Singh, who presided over the case, highlighted that minority institutions have an absolute right to appoint their staff, and the role of the DoE is limited to ensuring that the staff meets the necessary qualifications. The court also directed the release of grant-in-aid for the salaries of the newly recruited staff, subject to the school removing any unqualified staff, and compliance with a future decision regarding a marking scheme circular whose validity remains open.


The court's decision emphasizes the constitutional protection afforded to minority institutions under Article 30, allowing them to manage and administer their affairs independently, provided they adhere to the prescribed qualifications and experience for staff appointments.
