Delhi High Court Upholds Rejection of Candidates' Nominations in Town Vending Committee Elections

Court dismisses petition to ensure timely conduct of elections crucial for street vendors, advises petitioners to seek legal remedies post-election.

In a significant development, the Delhi High Court has dismissed a writ petition filed by four candidates challenging the rejection of their nominations for the upcoming Town Vending Committee (TVC) elections. The judgment, delivered by a bench comprising Justices Prathiba M. Singh and Vikas Mahajan, underscores the necessity of adhering to the election schedule to avoid disruptions in the election process.

The petitioners, Dharamveer and others, had contested the decision of the Municipal Corporation of Delhi (MCD) to reject their nominations on various grounds, including clerical errors in names and category certifications. The court, however, emphasized the advanced stage of the election process, with ballot papers already printed, and the potential disruption that entertaining individual grievances at this stage could cause.

The court noted that the elections are pivotal for the reconstitution of the TVC, a body essential for addressing the issues faced by street vendors in Delhi. The Supreme Court had earlier directed the reconstitution of TVCs within a fixed timeline, highlighting the urgency and importance of these elections.

Ms. Puja S. Kalra, representing the MCD, informed the court of the election schedule and the actions taken to resolve nomination anomalies. Despite attempts to address the issues, the MCD maintained that the rejection of nominations was necessary due to non-compliance with category certification requirements within Delhi.

Justice Prathiba M. Singh, delivering the oral judgment, stated, "The TVC elections are extremely crucial, and any delay could impede the resolution of street vendor issues across the city." The court further advised the petitioners to pursue legal remedies after the elections, ensuring their grievances are addressed without hindering the electoral process.

The decision reaffirms the judiciary's commitment to uphold electoral timelines and processes, ensuring that critical elections proceed without undue delay, thereby enabling effective governance and representation for the street vendor community in Delhi.

Bottom line:-

Town Vending Committee Elections - Grievances of individual candidates cannot disrupt the election process, especially after ballot papers are printed and elections are imminent - Reconstitution of TVC directed by Supreme Court to be conducted within a fixed timeline.
