Court Rules in Favor of 92-Year-Old Foreign National, Allows Manual Tax Reconciliation Despite Procedural Norms


In a significant ruling, the Delhi High Court has upheld a decision by the Income Tax Appellate Tribunal, allowing a 92-year-old foreign national, Marguerite Lasusa Chawla, to adjust advance tax paid in the financial year 2015-16 against her income for the assessment year 2018-19. The judgment, delivered by a division bench comprising Justices Dinesh Mehta and Rajneesh Kumar Gupta, emphasized the importance of justice over procedural technicalities given the unique circumstances of the respondent.


The Commissioner of Income Tax, represented by Senior Standing Counsel Mr. Puneet Rai, challenged the Tribunal's order, arguing that the adjustment granted was beyond its powers and not in alignment with standard procedural norms. The counsel contended that Ms. Chawla should have filed returns for the assessment year 2016-17 to claim a refund and separately paid the tax for the assessment year 2018-19.


However, the High Court noted the exceptional circumstances of Ms. Chawla, considering her advanced age and foreign nationality. The court affirmed the Tribunal's decision, highlighting that it was a matter of justice to allow the adjustment, even if it deviated from procedural norms. To mitigate the financial impact on the Revenue, the court directed that the refund be processed without any interest, as per Sections 244A and 244A(1A) of the Income Tax Act, 1961.


The court further instructed the tax authorities to perform manual reconciliation of the advance tax and the income returns, given the limitations of the electronic processing system in handling such discrepancies. This approach is intended to ensure that justice is served while addressing the practical challenges faced by the tax department.


The ruling underscores the court's willingness to adapt procedural requirements to achieve equitable outcomes, particularly for individuals in exceptional situations. The matter has been listed for further proceedings on October 1, 2026, to ensure compliance with the court's directives.
