Chennai, July 23 Vilathikulam DMK legislator G V Markandayan, who had been arrested by the police for allegedly making derogatory, abusive and threatening remarks against Chief Minister C Joseph Vijay, has approached the Madras High Court to set aside the remand order passed by the Tuticorin Judicial Magistrate.
Justice G K Ilanthiraiyan, before whom the petition filed by Markandayan came up for hearing on Thursday, adjourned the matter to July 27 after Public Prosecutor R John Sathyan sought time to get instructions.
In his petition, Markandayan said the offences for which he has been charged were punishable with imprisonment for a term which may extend to seven years.
However, the police, without issuing a notice under section 35 (3) of the BNS, have arrested him.
As per the Supreme Court guidelines, the police were bound to issue a notice under section 35 (3) of the BNS, and the apex court had cautioned that non-compliance would render such arrest unlawful, and also amount to abuse of process of law.
Based on a complaint given by a person, S Balasubramanian, the Tuticorin crime branch registered a case and arrested him on July 20, 2026, he added.
