Mumbai, Aug 6 The Bombay High Court on Thursday said it intends to grant bail to Shiv Sena corporator Ramesh Mhatre, accused of assaulting doctors at a municipal hospital in Thane district, with strict conditions, including asking him to stay outside Maharashtra until the chargesheet is filed.
After hearing all the parties concerned, a bench comprising Acting Chief Justice Ravindra V Ghuge and Justice Gautam Ankhad listed some of the bail conditions and said a formal order would be passed on Friday.
Besides directing the politician not to enter the state until the filing of the chargesheet, he will also be told not to contact witnesses directly or indirectly and provide the address and contact number of the place where he will be staying.
During the hearing on Thursday, when the court inquired about the status of the chargesheet, Public Prosecutor Sishir Hiray said it can be filed after they receive the forensic analysis report.
The court then directed the Kalina forensic laboratory to submit the report of the voice sample of the accused within ten days.
The bench also insisted that an experienced special public prosecutor be appointed in the case.
Taking suo motu cognisance, the HC had on July 18 stayed the bail granted to Mhatre by a lower court.
A court in Thane district on July 14 granted bail to Mhatre, a corporator of the Kalyan-Dombivli Municipal Corporation.
The politician and his aides were arrested for allegedly assaulting two doctors and nurses at a civic-run hospital in Dombivli on the night of July 6 after a family was advised to shift a newborn to another facility, triggering a massive uproar.
