In a significant ruling, the Gauhati High Court has revised the compensation awarded to the legal heirs of a deceased auto-rickshaw driver involved in a tragic motor vehicle accident. The court increased the compensation from Rs. 15,85,000 to Rs. 22,06,000, factoring in future prospects and reassessment of conventional compensation heads as per the guidelines established by the Supreme Court.
The case, titled "State of Arunachal Pradesh v. Smt. Rejina Sonowal," revolved around a motor accident that occurred on March 4, 2011, leading to the death of 35-year-old Dipen Sonowal, who was driving an auto-rickshaw when it was hit by a bus. The Motor Accident Claims Tribunal (MACT), Tinsukia, initially awarded compensation, but it did not include future prospects or reassess conventional heads in line with Supreme Court precedents.
Presided over by Justice Kaushik Goswami, the High Court revisited the case under the provisions of the Motor Vehicles Act, 1988. The court noted that the deceased was self-employed and below 40 years of age, thereby warranting a mandatory addition of 40% to his established income towards future prospects, in accordance with the Supreme Court's decision in the Pranay Sethi case.
Justice Goswami emphasized that the Tribunal failed to properly assess the compensation under conventional heads such as funeral expenses, loss of estate, and loss of consortium, thus necessitating a revision. The court reassessed the monthly income of the deceased to include future prospects, calculated the loss of dependency using the multiplier method, and adjusted the amounts under each head, ultimately arriving at the enhanced compensation figure.
Furthermore, the court dismissed the appellant's plea to interfere with the ex parte award given by the Tribunal, citing that the State of Arunachal Pradesh had ample opportunity to contest the claim but failed to participate in the proceedings effectively.
This judgment reinforces the application of Supreme Court guidelines in determining fair compensation for victims of motor accidents, ensuring that future prospects and appropriate assessments under conventional heads are given due consideration.
