Lucknow, Jul 31 The Lucknow bench of the Allahabad High Court has ruled that the population of a gram panchayat under the Uttar Pradesh Panchayat Raj Act must be determined solely on the basis of the last published Census and not its present-day population.
The bench comprising Justices Alok Mathur and Amitabh Kumar Rai also held that a gram panchayat cannot continue to exist unless it meets the statutory minimum population prescribed under the Act.
With this, the court upheld the state government's decision to dissolve Karua gram panchayat in Gonda district and merge it with Kumhraura gram panchayat.
