Court Criticizes Revenue Department's Missteps and Affirms Trust's Eligibility for Tax Exemption Under Section 10(23C)(vi)


In a landmark decision, the Gujarat High Court has nullified the reassessment proceedings initiated by the Deputy Commissioner of Income Tax against the Ahmedabad South Indian Association Charitable Trust. The court ruled that the reopening of the assessment was unjustified, as the Trust's utilization of income for charitable purposes exceeded the statutory threshold, thereby qualifying for tax exemption under Section 10(23C)(vi) of the Income Tax Act, 1961.


The case revolved around the Trust's claim for exemption, which was initially accepted but later challenged by the tax authorities, leading to the reopening of the assessment for the year 2017-18. The Department alleged escapement of income, citing irregularities such as unsubstantiated staff welfare expenses and disputed remuneration to a trustee. However, the Trust effectively demonstrated that even after excluding the disputed amounts, their charitable expenditure surpassed the required 85% of total receipts, maintaining their exemption eligibility.


Presiding over the case, Justices A.S. Supehia and Vaibhavi D. Nanavati criticized the Assessing Officer for proceeding with the reassessment despite an interim court order restraining such action. The court noted that the Revenue Department's inability to withdraw the assessment order due to technical constraints in their system was not a valid excuse, highlighting the powers under Section 264 of the Act for rectifying such errors.


The judgment underscored the procedural lapses and the necessity for judicial compliance by tax authorities. The court also remarked on the potential for contempt proceedings due to the violation of interim orders. Ultimately, the court's decision reinforces the legal framework protecting charitable institutions from unwarranted tax claims, emphasizing the importance of adhering to statutory provisions and judicial directives.
