Kolkata, Sep 11 A division bench of the Calcutta High Court on Friday permitted the West Bengal government to file a review application before a single bench against its order allowing a meeting of former CM Mamata Banerjee on private land in Sreerampur.
Disposing of an appeal filed by the state government and the private landowner, the division bench headed by Chief Justice Ravindra Vithalrao Ghuge requested the single-judge bench to decide the review plea, if filed, by September 25.
The state had challenged the order of Justice Saugata Bhattacharyya, which permitted the meeting on Friday instead of a proposed rally along the congested GT Road.
The state contended before the division bench that the single judge had not taken into consideration its submission that the venue was privately owned and that the landowner's consent was required for the meeting.
The division bench then stayed the meeting after the TMC informed it that it was amenable to postponing it.
The division bench, also comprising Justice Tapabrata Chakraborty, directed petitioner Asit Majumdar, a former TMC MLA, to file his opposition, if any, by September 16.
The bench requested Justice Bhattacharyya to hear the review application on September 18 and pass orders by September 25.
