Prayagraj, Sep 28 Taking note of the large number of contractual and ad hoc appointments in government medical and nursing colleges in Uttar Pradesh, the Allahabad High Court has asked the state Director General (Medical Education and Training) to file a personal affidavit with details about the number of vacancies for the post of professors in all medical colleges in the state.
The court passed the directives when it was brought to its notice that more than 500 postings are on a contractual basis in Uttar Pradesh and hardly 2-3 per cent of the posts are filled with regular employees.
Justice Siddharth Nandan, in the order passed on September 23, also directed the director general to file details of the requisition sent for filling up the posts of professors in various medical colleges in the state, details of the advertisement issued and their current status in the affidavit.
The court further said that the details of vacancies for which no advertisement has been issued in spite of the requisition sent be also mentioned along with the reasons for not advertising such vacancies.
The order was passed hearing a petition filed by principal-cum-professor of Government College of Nursing, Badaun, Srinivasan Gandhi.
The petitioner had challenged the order dated June 3, 2025, whereby his contractual appointment was cancelled on the ground that, as per a government order dated April 15, 2022, such contractual appointment cannot be extended beyond a period of three years.
The counsel for the petitioner, while citing the decision of the Supreme Court in the case of Manish Gupta and another Vs. President, Jan Bhagidari Samiti and others (2022), submitted that an ad hoc employee cannot be replaced by another ad hoc employee and can be replaced only by a regularly selected candidate.
The court directed the listing of the case on October 13, 2026, for further hearing.
