Court Demands Explanation for Non-Compliance and Exclusion of Ramsar Sites in Integrated Management Plans
In a significant move towards environmental conservation, the Jammu & Kashmir and Ladakh High Court has directed the Union Territory of Jammu and Kashmir to submit a detailed response to the Ministry of Environment, Forest and Climate Change concerning the Integrated Management Plans (IMPs) for wetlands. This directive comes in the wake of the court's scrutiny of the UT's adherence to the National Plan of Conservation of Aquatic Ecosystem (NPCA) guidelines.
During the proceedings of the case Kashmir Environmental Protection v. State of JK, the court noted the Ministry's communication dated 10th September 2025, which highlighted the non-conformity of the UT's proposals with the NPCA scheme. The Ministry had previously communicated the need for separate IMPs for each wetland in accordance with the NPCA guidelines of 2024, a directive that the UT has yet to comply with.
The bench, comprising Mr. Sanjeev Kumar, A.C.J., and Mr. Mohd Yousuf Wani, J., expressed concern over the UT's lack of response and directed that an affidavit be filed, explaining the reasons for the delay and the exclusion of other Ramsar sites in the region from the IMPs. The affidavit is to be submitted within three weeks, and the case is scheduled for further hearing on 21st September 2026.
In addition to seeking compliance, the court has also instructed the Registrar Judicial in Srinagar to release a remuneration of Rs. 25,000 to Mr. Nadeem Qadri, the learned Amicus Curiae, for his legal assistance to the petitioner.
This case underscores the judiciary's role in enforcing environmental regulations and ensuring that local authorities adhere to national conservation policies. As the proposal for the continuation of the NPCA scheme for the 2026-31 financial cycle is under consideration, the court's intervention is timely and critical for the preservation of the region's ecological assets.
