Court Emphasizes Welfare of Minor Over Allegations Between Parents in Custody Battle

In a significant judgment, the Jammu & Kashmir and Ladakh High Court has overturned a trial court's decision concerning the interim custody of a minor child, emphasizing the paramount importance of the child's welfare over unproven allegations between the parents. The case involved a custody battle between Muskan @Shagufta Kousar and Ashu Raja, concerning their six-year-old daughter, Ayra Vohra.


The case arose from a matrimonial discord between the parties, who had married in 2015 under both Hindu and Islamic rites. Following disputes, multiple legal proceedings ensued, including criminal allegations by the petitioner, Muskan, against the respondent, Ashu.


The trial court had previously ruled in favor of the father, Ashu, attributing the mother's custody claim to alleged misrepresentation and frivolous criminal complaints. However, the High Court, led by Justice Sanjay Parihar, found the trial court's decision was unduly influenced by these allegations, which were still under investigation and not conclusively proven.


Justice Parihar highlighted that custody decisions should not be swayed by ongoing matrimonial or criminal disputes, underscoring that the welfare of the child must remain the court's primary concern. The court noted that the Child Welfare Committee had previously restored custody to the mother after considering the child's comfort and well-being.


Setting aside the trial court's order, the High Court restored interim custody to the petitioner-mother, allowing the father visitation rights to ensure the child maintains a meaningful relationship with both parents. The court directed the trial court to expedite the final adjudication of the guardianship petition, underscoring that observations made in the High Court's order should not influence those proceedings.


This judgment reaffirms the legal principle that a child's welfare supersedes parental rights and allegations, guiding future custody disputes in similar contexts.

Custody of a minor child under the Guardians and Wards Act must be determined exclusively on the touchstone of the welfare and best interests of the child, avoiding influence from unproved allegations or matrimonial disputes between parents.
