In a significant judgment, the Jharkhand High Court has upheld the conviction of Samir Kumar Choudhary, a former Fund Clerk at Basudeopur Colliery, BCCL, Dhanbad, under Sections 7 and 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, 1988. The court, however, reduced the sentence, considering the passage of time since the incident, absence of prior criminal history, and proportionality of the punishment.
The case dates back to 1993 when the accused was caught demanding and accepting a bribe of Rs. 300 for processing the arrear payment of Provident Fund dues of the complainant, Ramdhari Harijan, a former employee at the colliery. Following a detailed investigation by the CBI and a sting operation that confirmed the allegations, Choudhary was initially sentenced to two years of rigorous imprisonment by the Special Judge, CBI-cum-3rd Additional Sessions Judge, Dhanbad.
During the appeal, the defense argued about the contradictions in witness statements and the lack of substantial evidence. However, Justice Pradeep Kumar Srivastava, presiding over the case, found these contradictions insubstantial and maintained that the prosecution effectively proved the demand, acceptance, and recovery of the bribe money.
The court noted the mitigating factors such as the time elapsed since the incident—over three decades—and Choudhary's lack of prior criminal antecedents. Recognizing these factors, the court modified the sentence to the period already undergone—one month and one day—along with the fine already paid, including a conditional fine of Rs. 5,000 for bail confirmation.
The appeal was dismissed on merits, but the sentence was modified, allowing Choudhary to be discharged from his bail liabilities. This judgment underscores the court's approach towards balancing justice with the passage of time and the individual's conduct post-conviction.
