Court Rules in Favor of Employee, Citing Fairness and Equality Principles in Service Law


In a significant judgment, the Karnataka High Court has upheld the decision of the Karnataka State Administrative Tribunal (KSAT) to grant promotion benefits to a government employee who assumed a higher post on the day of his superannuation. The case, State of Karnataka v. Sri. Rangaswamy A.R., centered around whether promotional benefits should be accorded to a government servant who took charge of a higher post in the afternoon of his retirement day.


Sri. Rangaswamy A.R., who was appointed as a School Headmaster in 1994, was promoted to the cadre of Professor at C.T.E., Jamkhandi, on May 31, 2023. On the same day, he was relieved from service due to retirement. The dispute arose when the State Government denied him the promotional benefits, reasoning that his assumption of duties at 5:20 p.m. did not warrant the benefits, as per Rule 23 of the Karnataka Civil Services Rules, which states that promotions involving change of duties take effect from the date the duties of the higher post are assumed.


The KSAT quashed the State Government's endorsement rejecting Rangaswamy's request for promotional benefits and ordered the State to grant all consequent benefits. The High Court, comprising Justices Mohammad Nawaz and Venkatesh Naik T, dismissed the State's petition against the KSAT's order. The court emphasized that denying benefits based on the time of duty assumption is unreasonable and contradicts the principles of fairness and equality under service law.


The court highlighted that Rule 23 clearly stipulates promotions involving changes of duty are effective from the date of assuming the higher post. The judgment also referenced several legal precedents, reinforcing that promotion rights crystallize upon assumption of the post, regardless of the time of day. The High Court's decision aligns with the established legal principle that promotion becomes effective from the date it is granted, not when a vacancy arises.


The ruling is significant as it underscores the importance of adhering to principles of fairness in employment matters and sets a precedent that could impact similar cases in the future. The court's decision ensures that government employees are not unjustly deprived of their rightful benefits due to arbitrary interpretations of service rules.


Bottom line:-

Promotion benefits cannot be denied to a government employee who assumes charge of a higher post on the date of superannuation, as promotions take effect from the date the duties of the higher post are assumed, irrespective of the time of the day.
