The case originated when Mohandas, an insured employee working as a toddy tapper, suffered a "Stable Compression Fracture L2" due to an accident on October 21, 2010. The ESI Medical Board assessed his permanent disablement at 20%, but the EI Court revised this figure to 100%, based on additional medical evidence. The ESI Corporation contested this ruling, arguing that the EI Court failed to follow established judgments, including those in "Pushkaran" and "Vanajakshan."


The High Court, presided over by Justice S. Manu, found that the EI Court did not properly analyze the dispute in line with binding judgments, which require consideration of an employee's ability to perform any work, not just the job held at the time of injury. The Court highlighted that the evaluation must focus on general work capability rather than specific employment.


The High Court's decision emphasizes the necessity for the EI Court to reassess the case, allowing both parties to present amended pleadings and new evidence. The EI Court has been instructed to re-adjudicate the case expeditiously, with a deadline of six months for a new judgment.
