Kerala High Court Restricts Sports Council's Authority in Kerala Hockey Election Dispute

Court affirms limited role of Sports Council in election inquiries, mandates technical committee for athlete welfare

The Kerala High Court, in a significant ruling on April 1, 2026, delineated the authority of the Kerala State Sports Council concerning its role in the election processes of registered sports organizations. The bench, comprising Justices Sathish Ninan and P. Krishna Kumar, adjudicated a series of writ appeals involving the internal elections and governance issues within "Kerala Hockey," a society registered under the Societies Registration Act.

The court emphasized that the Sports Council could only investigate election irregularities for the purpose of recognition or withdrawal of recognition under Section 31A of the Kerala Sports Act. It clarified that the Council lacks the authority to interfere with the internal operations of a registered society, including the conduct of elections or the enforcement of by-law amendments.

This ruling arose from a convoluted series of events where allegations of financial irregularities and improper election procedures were leveled against Kerala Hockey. These allegations led to multiple inquiries, reports, and government interventions. The court underscored that while the Sports Council could investigate election irregularities, its role was confined to the implications of recognition status and did not extend to direct electoral oversight.

In a detailed order, the High Court set aside government directions to dissolve Kerala Hockey and conduct new elections through an ad-hoc committee, reinforcing the autonomy of the society in managing its internal affairs. It acknowledged ongoing disputes about by-law amendments and the eligibility of office bearers under Section 31A(3) of the Sports Act, given prior de-recognitions due to financial misconduct.

Furthermore, the court directed the establishment of a technical committee by the Sports Council to ensure the rights and interests of hockey players in Kerala are protected during the ongoing disputes. This directive aligns with the Sports Council's broader mandate to promote and regulate sports in the state, as outlined in Section 5 of the Kerala Sports Act.

The judgment is pivotal in defining the contours of administrative oversight in sports governance, balancing regulatory authority with organizational autonomy. The decision also mandates the Sports Council to initiate proceedings under Section 31A(2) to address recognition issues without delay, ensuring procedural fairness and adherence to statutory provisions.

Bottom line:-

Sports Associations - Validity of elections and amendments to bye-laws of a registered Society - Enquiry by State Sports Council - Sports Council has limited authority under Section 31A of the Kerala Sports Act to enquire into lapses in election processes for purposes of recognition or withdrawal of recognition of Sports Organizations.
