Kerala High Court Sets Precedent on DRT Registrar's Powers

Tribunal's Rejection of Application Without Formal Adjudication Overturned

In a landmark judgment, the Kerala High Court has clarified the limitations of the powers of the Registrar at the Debts Recovery Tribunal (DRT). The court ruled that the Registrar, a Chief Ministerial Officer, cannot exercise judicial functions such as referring applications to the Presiding Officer or rejecting applications based on maintainability or locus standi. This decision came in response to the case of Fathima M.P. v. IDBI Bank Ltd., where the DRT had previously rejected an application at a preliminary stage without formal adjudication.

The petitioner, Fathima M.P., challenged the coercive actions taken under the SARFAESI Act by filing an application with the DRT, which was initially rejected by the Tribunal as "not maintainable." The Registrar had placed the unnumbered application before the Tribunal to decide its maintainability, leading to its rejection without a full hearing.

Justice P. V. Balakrishnan ruled that the Registrar’s role is limited to scrutinizing applications for formal defects and allowing rectification. The Registrar is not empowered to make judicial decisions or refer applications to the Presiding Officer without proper adjudication. The ruling emphasized that substantial issues such as maintainability or locus standi require formal adjudication and cannot be dismissed at the preliminary stage without a proper hearing.

The court's decision sets aside the previous order by the DRT and remits the case back to the Registrar for reconsideration in accordance with Rule 5 of the Debts Recovery Tribunal (Procedure) Rules, 1993. The judgment underscores the necessity for formal adjudication on substantial issues, ensuring fair trial processes are upheld in tribunal proceedings.

Bottom Line :

Debts Recovery Tribunal Registrar's powers and procedure under Rule 5 of Debts Recovery Tribunal (Procedure) Rules, 1993 clarified. Registrar cannot exercise judicial functions, refer applications suo motu, or reject/dismiss applications on grounds of maintainability or locus standi.
