Kerala High Court Stays Teacher's Suspension Amid Quiz Controversy

Court emphasizes academic objectivity over political considerations in disciplinary proceedings


In a significant development, the Kerala High Court, presided over by Justice Viju Abraham, has stayed the suspension of Guruprasad Rai K, a teacher at AUPS Pallathadka Aided School, for a period of one month. The suspension was initially imposed following a controversy over the historical accuracy of a quiz question prepared by the teacher. The question, part of the 'Social Science Club Freedom Quiz 2026', asked about the freedom fighter who received the maximum punishment from the British, to which the answer provided was "V.D. Savarkar". This sparked public complaints and led to the teacher's suspension under Section 12A of the Kerala Education Act, 1958.


The court highlighted that suspension during disciplinary proceedings is discretionary and not automatic, as established in the Division Bench judgment of Vikraman Nair K. v. State of Kerala. The High Court underscored the necessity for the enquiry to be rooted in academic objectivity rather than being influenced by external or political considerations. The court has thus directed the enquiry to continue but found the continued suspension of the petitioner unnecessary for its proper conduct.


The petitioner argued that the question paper, including the controversial question, was prepared and sent to the Assistant Education Officer (AEO) for scrutiny, who then distributed it to school headmasters without objection. The court noted that no action has been taken against the AEO, who was also aware of the question's content.


Justice Abraham's order pointed out that the disciplinary proceedings were initiated due to alleged negligence of duty rather than any ideological bias. The court has advised the educational authorities to constitute an independent academic expert analysis committee to evaluate the historical veracity and academic propriety of the disputed quiz question.


The High Court's interim order reflects a balance between maintaining academic standards and ensuring fair treatment of educators, emphasizing that disciplinary measures should not be driven by political pressures.
