Amicable Settlement Influences Sentence Reduction; Conviction for Rash Driving Resulting in Death Stands


In a significant ruling, the Kerala High Court has upheld the conviction of Suresh Kumar for rash and negligent driving under Sections 279 and 304A of the Indian Penal Code, while modifying the sentence following an amicable settlement between the parties. The judgment, delivered by Justice Jobin Sebastian on July 1, 2026, came in response to a revision petition filed against the decisions of the lower courts.


The case originated from a tragic road traffic accident on August 15, 2004, which resulted in the death of a motorcyclist due to the alleged reckless driving of Suresh Kumar. The trial court had sentenced Kumar to one year of simple imprisonment under Section 304A and six months under Section 279, along with a suspension of his driving license for six months.


Upon appeal, the Additional Sessions Court-I, Mavelikara, upheld the trial court's decision. However, during the revision hearing, it was revealed that the parties had reached an amicable settlement, and compensation was paid to the deceased's legal heirs under the Motor Vehicles Act.


Justice Sebastian noted the compelling evidence presented by occurrence witnesses, which corroborated the prosecution's claims of rash and negligent driving. While affirming the conviction, the court recognized the settlement's implications on sentencing, emphasizing the societal impact of such offenses and the non-compoundable nature of Section 304A.


The court modified the sentence to imprisonment till the rising of the court, accompanied by a compensation payment of Rs. 10,000 to the deceased's wife, in accordance with Section 357(3) of the Code of Criminal Procedure. A fine of Rs. 500 was also imposed under Section 279, with default clauses specified for both penalties.


The revision petitioner has been directed to appear before the trial court on September 2, 2026, to receive the modified sentence. This judgment highlights the judiciary's balanced approach in considering restorative justice while upholding legal principles in cases with broader societal implications.
