Court Dismisses Petition for Reappointment, Affirms Compliance with Kerala Government Law Officers Rules, 1978
In a recent judgment, the Kerala High Court upheld the termination of Anil Kumar P.R., a Government Law Officer, upon attaining the age of 60, as per the Kerala Government Law Officers (Appointment and Conditions of Services) and Conduct of Cases Rules, 1978. The court dismissed his plea for reappointment or extension, reinforcing that such a request cannot be claimed as a right.
The petitioner, Anil Kumar P.R., had been serving as an Additional Government Pleader and Additional Public Prosecutor in the Additional District and Sessions Court-II, Pathanamthitta, under a three-year tenure or until reaching the age of 60, whichever came first. Upon reaching the age limit on May 20, 2026, he sought an extension or reappointment through a representation to the state government, which was subsequently rejected.
Justice Viju Abraham, presiding over the case, emphasized that the termination was in strict accordance with Rule 9 of the 1978 Rules, which mandates automatic termination at 60 years of age. The court found no merit in the petitioner's argument of discrimination, as all other officers were similarly restricted to serve until the same age.
The petitioner argued that the Rules were not applicable to him, citing decisions from previous cases such as "Joseph P.T. (Advocate) v. State of Kerala" and "State of Kerala v. P.P. Biju," claiming that those judgments supported his case. However, the court clarified that these cases did not apply to his situation as they dealt with different circumstances regarding the continuation of services post-retirement age without replacement.
Furthermore, the court reiterated the procedural adherence required under Section 24(3) of the Criminal Procedure Code, 1973, for appointing Public Prosecutors, which remains unaffected by the Rules, 1978, as clarified in earlier judgments.
The government's decision to assign additional charge to another Public Prosecutor was also validated by the court, ensuring the continued smooth operation of court functions.
In conclusion, the Kerala High Court found no fault with the government's decision and dismissed Anil Kumar P.R.'s writ petition, thereby upholding the original termination decision under the applicable statutory provisions.
Bottom line:-
Termination of service of Government Law Officer upon attaining age of 60 years upheld; reappointment or extension cannot be claimed as a matter of right under Kerala Government Law Officers Rules, 1978.
