Kerala High Court Urges Renaming of Mental Health Centres to Combat Stigma

Court suggests rebranding to promote community welfare and address societal perceptions under the Mental Health Care Act, 2017.


In a landmark decision aimed at addressing the societal stigma associated with mental health, the Kerala High Court has urged the State Government to consider renaming "Mental Health Centres." The Court emphasized the importance of altering the nomenclature to foster a perception of these institutions as facilities for community welfare and development rather than centers catering exclusively to mental disorders.


The judgment, delivered by a bench comprising Justices Devan Ramachandran and Basant Balaji, was in response to an issue brought forward by Smt. Sathyasree Priya, the Amicus Curiae, who highlighted the negative connotations associated with the term "Mental Health Centres." The court noted that such terminology often leads to societal stigma, impacting the dignity and acceptance of individuals seeking mental health care.


During their recent visits to several mental health facilities, the judges observed firsthand the stigma these centers endure. The Amicus Curiae suggested renaming these facilities to "Institutes of Behavioural Management" or a similar term that would not carry the same societal burden.


While the Court refrained from prescribing a specific name, it conveyed a firm stance that the Government should consider this initiative seriously. The judgment remarked on the inconsistency in naming conventions, noting that other healthcare facilities do not label themselves as "Centres of Physical Health," hence questioning the rationale behind the current nomenclature for mental health institutions.


The Court acknowledged that the existing protocols under the Mental Health Care Act, 2017 might necessitate the current naming, yet it insisted on a reevaluation to prevent the perpetuation of stigma. Recognizing the decision as a policy matter, the Court directed the competent Government Authority to evaluate the suggestion and report back by September 15, 2026.


The judgment further clarified that the matter should not be approached adversarially, asserting that the primary concern is the welfare of vulnerable patient groups. The Court's directive aims to ensure that these centres are viewed as integral to community welfare and development, dissociated from any negative connotations.


The decision underscores a progressive step towards destigmatizing mental health care, aligning with broader global trends to enhance the dignity and societal integration of individuals with mental health needs.
