In a significant ruling dated September 3, 2026, the Madhya Pradesh High Court (Jabalpur Bench) presided over by Justice Ratnesh Chandra Singh Bisen, cancelled the bail granted to accused Dheer Singh, following serious allegations of violation of bail conditions, breach of victim privacy, and attempts to influence prosecution witnesses. The case arose from an application filed by the victim, identified as Victim A, under Section 483(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), seeking cancellation of the bail previously granted to Dheer Singh by the same Court on September 1, 2025. The bail was subject to conditions prescribed under Section 480(3) of BNSS, aimed at safeguarding the victim and ensuring a fair trial.
The victim alleged that after being released on bail, Dheer Singh violated the bail conditions by breaching her privacy. It was contended that he used fake social media profiles named 'Sofi' and 'Sofia' to send objectionable videos and messages to her in-laws, including her mother-in-law, father-in-law, and sister-in-law. Moreover, the accused was accused of pressurizing the victim to provide statements favorable to him. Despite complaints to the Superintendent of Police, Satna, and to the Chief Minister's Helpline, no effective action was taken initially.
The Court examined the submissions of both parties. The accused denied the allegations and claimed innocence, also stating that he had lost his mobile phones purportedly used to send the offending messages. However, the Court observed that there was no concrete evidence to support this claim, such as intimation to mobile service providers about the loss, which raised doubts about the accused's explanation.
Justice Bisen emphasized the gravity of the accused's conduct, noting that sending objectionable content to the victim's family members and pressuring the victim could adversely affect the dignity and privacy of the victim. Such actions threaten the fairness of the trial by potentially influencing prosecution witnesses.
Highlighting the importance of strict compliance with bail conditions, particularly in cases involving sexual offences, the Court stated that bail liberty must not be misused. The Court held that the power under Section 483(2) of BNSS extends beyond the original allegations to include violations of bail conditions and interference with the judicial process.
Consequently, the Court found sufficient grounds to cancel the bail of Dheer Singh and ordered his immediate custody. This decision sends a clear message that the judiciary will not tolerate attempts to intimidate victims or undermine justice through misuse of bail.
