Court Issues Orders for Infrastructure Development to Safeguard Judges' Privacy and Security


In a landmark ruling, the Madhya Pradesh High Court, Jabalpur Bench, has directed the State Government to prioritize the security and housing facilities for District Judges and Magistrates. The decision, stemming from a suo motu Public Interest Litigation (PIL), underscores the urgency of providing adequate infrastructure to ensure the privacy, security, and independence of the judiciary.


The bench, comprising Mr. Anand Pathak and Mr. B.P. Sharma, emphasized the critical need for state intervention following incidents that highlighted vulnerabilities faced by judicial officers residing in rented accommodations. The court noted that judges dealing with criminal trials, family disputes, civil cases, and politically sensitive matters are increasingly exposed to potential threats from litigants and accused parties, necessitating state action to protect them.


During the proceedings, affidavits from the Director General of Police and Additional Chief Secretary (Home) were submitted, detailing current measures. However, the court found these measures insufficient and reiterated the state's duty to ensure a secure and independent environment for judicial officers.


The court's order mandates the State to allocate sufficient funds for housing projects dedicated to judges, thereby addressing the lack of official accommodations. This move aims to reduce exposure risks and uphold the privacy and dignity expected of judicial officers.


A specific directive requires the Additional Chief Secretary (Home) to submit a comprehensive affidavit detailing the steps the State plans to undertake to tackle the infrastructural challenges. The court expressed its expectation for a concrete plan that addresses the housing deficits faced by district judiciary members.


Furthermore, the Judges' Association has been granted liberty to suggest additional remedial measures to enhance the security framework. These suggestions will be considered in the next hearing scheduled for the week commencing August 25, 2026.


This ruling highlights the judiciary's proactive stance in ensuring its members are protected and can function independently, free from undue pressures or risks. The judgment sets a precedent for other states to follow suit in safeguarding their judicial officers.
