Court Reverses Trial Court's Decision, Upholds Wife's Right to Maintenance Based on Husband's Earnings


In a significant ruling, the Madhya Pradesh High Court has overturned a trial court's decision, granting maintenance to a wife and enhancing maintenance for her minor child. The case, Garima v. Satish, examined the responsibilities of a husband under Section 125 of the Criminal Procedure Code, 1973, regarding maintenance obligations.


Presiding Judge Gajendra Singh assessed the circumstances and evidence presented. Initially, the trial court denied maintenance to Garima, the wife, on the grounds that she was living separately without sufficient cause. However, the High Court found this determination to be perverse, especially given the context of an FIR against the husband, Satish, alleging ill-treatment.


The High Court emphasized that the wife's obligations extend to caring for the minor child, and her separation was justified due to the allegations of ill-treatment and economic neglect. Notably, the court criticized the trial court for wrongly placing the burden of proving the husband's income on the wife. Highlighting that maintenance proceedings are social welfare measures, the court reaffirmed that it was the husband's responsibility to disclose his income details.


The judgment revealed that Satish, with qualifications of M.Tech and MBA, holds a significant position as DGM at EKI Energy Pvt. Ltd. Despite claims of financial liabilities, his earning capacity and lifestyle were deemed sufficient to fulfill his maintenance obligations.


Ultimately, the High Court awarded Garima a monthly maintenance of Rs. 30,000, and increased the maintenance for the minor child from Rs. 20,000 to Rs. 30,000, effective from the date of the application. This decision underscores the legal principles of fairness and responsibility in matrimonial disputes, ensuring that maintenance aligns with the standard of living and income of the responsible party.


Bottom line:-

Maintenance under Section 125 Cr.P.C. - Husband's liability to maintain wife and minor child must align with their standard of living; burden of proving income lies with the husband in social welfare proceedings.
