Court Directs State to Supply Goods as Per Challan, Acknowledging Technical Glitch in Software


In a significant ruling, the Madhya Pradesh High Court has directed the State of Madhya Pradesh to supply excise goods to the petitioners in compliance with the delivery challans generated before the expiration of their licenses. The court's decision came in response to multiple writ petitions filed by M/s. Malwa Realities Pvt. Ltd. and others, who sought delivery of goods that were delayed due to a technical glitch in the state’s software system.


Justice Sandeep N. Bhatt, presiding over the case, acknowledged the petitioners' claims that their inability to receive the excise goods stemmed from a fault in the government’s software. The glitch prevented the generation of necessary permits despite the petitioners having completed all requisite payments and formalities.


The court emphasized that the generation of a delivery challan signifies the transfer of title of goods under the Sale of Goods Act, 1930. Consequently, the state's failure to deliver the goods amounted to a breach of statutory duty. The judgment pointed out that state officials admitted to the technical issue and had received instructions to ensure manual permit issuance when the software malfunctioned.


The court ordered the state to fulfill its obligation by providing the excise goods as per the delivery challans, thus partially allowing the petitioners' plea. However, the court did not grant other reliefs, such as refund of penalties or interest payments, considering the petitioners approached the court after the license period had expired.


The judgment reinforces the principle that the state, while holding exclusive rights over excise goods, cannot unjustly retain goods post-payment due to technical errors. The decision is expected to impact how government departments handle similar future occurrences, emphasizing the need for accountability and timely resolution of technical issues.
