Madhya Pradesh High Court Upholds FIR in Matrimonial Cruelty Case, Rejects Quashing Petition

Court Emphasizes No Mini-Trial at Quashing Stage and Affirms Delay in FIR Filing Not Ground for Dismissal in Domestic Dispute

The Madhya Pradesh High Court, Jabalpur Bench, on October 5, 2026, declined to quash an FIR registered against a husband and his in-laws in a matrimonial cruelty and dowry demand case, reiterating the legal principles governing quashing of criminal proceedings and the limited role of the High Court under Section 482 of the Code of Criminal Procedure (CrPC). The petitioners, comprising the husband and his parents-in-law, had sought quashing of FIR No. 297/2026 registered at Bagsewaniya Police Station, Bhopal, under Section 85 of the Bharatiya Nyaya Sanhita, 2023 (B.N.S.S.), alleging false implication and delay in lodging the complaint.

The marriage between petitioner No. 1, Adarsh Rai, and respondent No. 2 was solemnized on January 26, 2025, but the wife had been residing separately at her parental home since March 18, 2025. The FIR was lodged more than a year later, on May 12, 2026. The petitioners argued that the delay rendered the complaint suspicious and contended that the dowry allegations were baseless, highlighting that gold ornaments and vehicles in question were purchased by them and not demanded as dowry. They also pointed to the absence of charges under the Dowry Prohibition Act and described the allegations as vague and omnibus.

Opposing the petition, the respondent and the State presented evidence of harassment, including cash and gold demands made during and after the marriage, supported by seizure of relevant documents and witness statements. The State underscored that the investigation had been completed and a charge-sheet filed, emphasizing the existence of prima facie material to proceed against the accused.

In its detailed judgment, Justice Pramod Kumar Agrawal referred extensively to Supreme Court precedents, including Supriya Jain v. State of Haryana (2023), Gulam Mustafa v. State of Karnataka (2023), and CBI v. Aryan Singh (2023), reiterating the cautious and sparing exercise of the High Court's power under Section 482 CrPC. The Court emphasized that it cannot conduct a "mini-trial" or assess the truthfulness or sufficiency of evidence at the quashing stage. Instead, the Court's jurisdiction is limited to determining whether the FIR and accompanying materials prima facie disclose a cognizable offence.

The judgment also addressed the delay in lodging the FIR, holding that a wife's patience in attempting reconciliation does not weaken her complaint or render the FIR a mere counterblast. Specific allegations of cruelty and dowry demand recorded in statements under Sections 180 and 183 of the B.N.S.S. were held sufficient to proceed. The Court refused to entertain disputed factual questions or documents presented by the accused, reserving such matters for trial.

In conclusion, the Court dismissed the petition, ordering the trial court to proceed uninfluenced by any observations made in the judgment and strictly in accordance with law.

This ruling affirms the judiciary's commitment to balance the rights of the accused with the protection of victims in matrimonial disputes, underscoring the limited scope of quashing petitions and the importance of thorough trial proceedings to resolve contested facts.

Bottom Line:

Quashing of FIR in matrimonial cruelty case - In proceedings under Section 528 BNSS/Section 482 CrPC, High Court cannot conduct a mini-trial, appreciate disputed defence material, or quash proceedings merely on ground of delay in lodging FIR when FIR and statements disclose specific allegations of cruelty and dowry demand.
