However, the court observed that Section 24 of the Hindu Succession Act, which disqualifies a widow from inheriting upon remarriage, does not extend this disqualification to the children of the deceased coparcener.
The court further noted that the daughter, as a Class I legal heir, had rightfully inherited her father's share and had already dealt with the property, thus creating third-party interests. Citing the inapplicability of precedents involving Section 25 of the Act, which concerns disqualification due to criminal acts, Justice Balaji emphasized that Section 24's scope was limited to the widow's disqualification alone.
The ruling reaffirms the legal position that the remarriage of a widow does not extinguish the coparcenary interest of the deceased, allowing other legal heirs to inherit.
