Court Upholds Restriction on Election Petition Filing to Constituency-Linked Electors and Candidates


In a significant judgment, the Madras High Court has dismissed an election petition filed by K. Prakasam, who challenged the election results of the Coimbatore South Assembly Constituency. Justice N. Anand Venkatesh ruled that the petitioner, neither an elector nor a candidate in the said constituency, lacked the legal standing to file the petition under the Representation of the People Act, 1951.


The petitioner, represented by Mr. B. Leelesh Sundaram, sought to annul the election of Mr. V. Senthil Balaji, alleging irregularities and bias in the electoral process. However, the court clarified that under Section 81 of the Act, only a candidate who contested or an elector from the constituency in question could maintain such a petition. The court reiterated that the term "elector" must be interpreted as an individual entitled to vote specifically in the concerned constituency, rejecting a broader interpretation that could allow any voter from any constituency to challenge election results.


The court emphasized that expanding the definition of "elector" would lead to inconsistencies and undermine the spirit of the legislation, potentially opening the floodgates to numerous election petitions post-elections. It noted that the petition seemed more akin to a public interest litigation, which is not permissible under the election petition framework.


This judgment reinforces the procedural requirements for election petitions, underscoring the necessity for petitioners to have a direct connection to the constituency involved, either as candidates or voters. The decision is a reminder of the stringent legal thresholds that govern election disputes in India.
