Madras High Court Nullifies Fraudulent Appointments in Town Panchayats

Court Orders Comprehensive Probe into Misuse of Disability Quota in Public Employment

In a significant judgment, the Madurai Bench of the Madras High Court has declared appointments obtained through fraudulent means under the disability quota as void ab initio. The court identified a large-scale organized fraud involving fake disability certificates used to secure public employment in Town Panchayats and Municipalities in Tirunelveli District. Justice B. Pugalendhi presided over the case, which involved numerous writ petitions challenging the termination of employment for alleged misrepresentation under the priority quota for physically disabled persons.

The judgment stems from an investigation initiated after Dr. V. Chandrasekaran, a Civil Assistant Surgeon, reported a fake National Disability Card bearing his forged signature. The investigation, transferred to the CB-CID, uncovered that numerous appointments were based on fake disability certificates, implicating brokers and officials in the fraud. Medical examinations revealed that only 25 out of the 103 appointees under the priority quota were genuinely disabled.

The Court upheld the termination of those who secured appointments through fraudulent means, emphasizing that fraud vitiates all proceedings and no equitable relief can be granted to those who misrepresent to obtain public employment. The judgment also highlighted systemic failures in the sponsorship process by the Employment Exchange and directed a comprehensive inquiry by a committee to address these deficiencies. The court ordered the Secretary, Labour Welfare and Skill Development Department, to conduct the inquiry and take appropriate actions within six weeks.

The judgment underscores the importance of integrity in public recruitment and the need for robust mechanisms to prevent the misuse of reservation benefits.

Bottom line:-

Public employment obtained fraudulently under priority quota for physically disabled persons is void ab initio. Fraud vitiates all proceedings and equitable relief cannot be claimed by candidates who misrepresent or misuse reservation benefits.
