Court Overrules Magistrate's Closure of Case as "Undetected," Citing Incomplete Investigation into Alleged Retaliatory Act
In a significant ruling, the Madras High Court, Madurai Bench, has ordered further investigation into an incident at the Tirunelveli Medical College men’s hostel, where a paver block was allegedly thrown from the hostel terrace, damaging a car. The petitioner, Dr. Kannan Baba, an Associate Professor and Senior Warden at the college, argued that the act was not mere mischief but possibly intended as intimidation following anti-ragging measures.
The Court noted several investigative lapses, including failure to examine access to the hostel terrace, lack of scrutiny of disciplinary records, and absence of forensic analysis. In response, the Court directed the Commissioner of Police, Tirunelveli City, to appoint a competent officer to lead a further investigation under senior supervision.
