Court Ends Executive Officer's Dual Role, Mandates Separate Entities for Temple Management


In a landmark decision, the Madras High Court has ordered significant changes in the administration of the Shri Parthasarathy Swamy Temple, Triplicane, Chennai. The Court ruled that the administration cannot continue under an Executive Officer-cum-Fit Person based on an outdated interim order from 1982, which ceased to have effect once the related appeal was disposed of in 1991.


The judgment, delivered by Justices G.R. Swaminathan and V. Lakshminarayanan of the Madurai Bench, emphasized the need for distinct roles in temple administration to ensure effective checks and balances. The Court highlighted that the roles of the Executive Officer and Fit Person should not be combined except in exceptional circumstances and for a brief period.


The decision stemmed from a public interest writ petition filed by activist T.R. Ramesh, who has been advocating for improved temple administration in Tamil Nadu. The petitioner argued against the long-standing practice where the Executive Officer, appointed by the HR&CE Department, also functioned as the Fit Person, a dual role that the Court found untenable.


The State of Tamil Nadu, represented by Additional Advocate General Mr. P.V. Balasubramaniam, acknowledged the historical basis for the current administrative structure but agreed to expedite the appointment of trustees for the temple within six months.


The judgment reinforced the statutory limits of the Executive Officer's powers under Section 45 of the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959. The Court clarified that the Executive Officer's duties are confined to the administration of temple properties and must not interfere with religious practices, which should be managed by those familiar with temple customs.


This decision is expected to bring structural reforms to the temple's administration, promoting a governance model that ensures accountability and respects religious traditions.

Administration of Shri Parthasarathy Swamy Temple, Triplicane, Chennai, cannot be continued by an Executive Officer-cum-Fit Person based on an interim order of 1982, as such an order ceases to have effect once the appeal is disposed of. The functions of an Executive Officer and Fit Person should not be combined in one individual except in exceptional circumstances, and only for a short duration. Executive Officers are restricted from interfering in the religious aspects of temple administration, as per Section 45(2) of the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959.
